Terms and Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of gshandcrafts.ca (the “Site”) and any purchases, rentals, or services provided through the Site.
By browsing the Site, creating an account, placing an order, submitting a custom request, or renting items, you agree to these Terms. If you do not agree, do not use the Site.

2) Changes to These Terms
We may update these Terms from time to time. The latest version will be posted on this page with an updated effective date. Continued use of the Site means you accept the updated Terms.
3) Eligibility and Account Responsibilities
You must be able to form a legally binding contract in your jurisdiction to place an order or rent items.
If you create an account, you are responsible for maintaining confidentiality of your login details and for all activity under your account.
You agree to provide accurate, complete, and current information during checkout and account registration.
4) Products, Handmade Variation, and Availability
Many items are handmade or produced in small runs, so natural variations in wood grain, color tone, finish, and minor dimensions can occur.
Product photos are for illustration. Actual colors may differ due to lighting, screen settings, or material variation.
We may limit quantities, discontinue products, or change product specifications at any time.
5) Pricing, Currency, Taxes
Prices are displayed on the Site and may change without notice.
Taxes and shipping fees (if applicable) are calculated at checkout or communicated during a custom order process.
If a pricing error occurs, we may cancel the order and refund any amounts paid.
6) Orders and Payments
An order is not accepted until we confirm it (for standard products) or confirm details and pricing (for custom orders).
We reserve the right to refuse, cancel, or limit any order, including suspected fraud, abuse, or unauthorized transactions.
7) Custom Orders
If you request a custom item (including custom signs, sizes, finishes, or personalized work):
You are responsible for confirming spelling, dates, measurements, and design approvals.
Production starts after confirmation of the final details (and any required deposit or payment).
Custom items are typically not refundable unless they are defective or not as agreed in writing. (This does not limit any non-waivable consumer rights in your jurisdiction.)
8) Digital Downloads
If you purchase digital products (for example, blueprints or downloadable files):
Access is provided digitally as described on the product page.
All digital download sales are final once access is delivered or the file is downloaded, except where required by law.
9) Shipping, Delivery, and Risk of Loss
Shipping and delivery timelines are estimates and not guaranteed.
Risk of loss transfers to you when the order is delivered to the carrier, unless your local law requires otherwise.
If a package arrives damaged, contact us promptly with photos of the packaging and item.
10) Returns, Refunds, and Exchanges
Returns and refunds are governed by our Refunds & Returns Policy on the Site.
In general:
Items must be returned in the same condition received (as described in the policy).
Custom items and digital downloads may have additional restrictions (see Sections 7 and 8).
11) Rentals
If you rent items (for example, wedding or event pieces listed under rental categories):
You agree to the following unless otherwise agreed in writing:
Rental period: As confirmed at checkout or in your booking confirmation.
Care and use: You must use items safely and as intended. Do not modify, paint, nail, cut, or permanently alter items.
Damage or loss: You are responsible for loss, theft, or damage during the rental period (normal wear and tear excepted).
Late returns: Late fees may apply and can be charged based on the daily rental rate or a reasonable late-return fee.
Deposit: We may require a security deposit for certain rentals and may apply it to damage, loss, or late returns.
12) User Content and Reviews
If you submit a review, photo, comment, or other content:
You confirm you have the rights to post it.
You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display it for marketing or site operation (unless you request removal where legally allowed).
We may remove content that is abusive, misleading, or violates these Terms.
13) Prohibited Use
You agree not to:
Use the Site for unlawful purposes.
Attempt to gain unauthorized access to the Site, accounts, or systems.
Interfere with the Site’s operation (including scraping, probing, or introducing malware).
Misrepresent your identity or submit fraudulent orders.
14) Intellectual Property
All Site content (logos, product images, text, design, and branding) is owned by or licensed to GS Handcrafts and is protected by intellectual property laws. You may not copy, reproduce, or distribute any content without written permission.
15) Third-Party Links and Services
The Site may link to third-party sites or services. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.
16) Disclaimers
The Site and all products/services are provided “as is” and “as available” to the maximum extent permitted by law.
Except as required by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
Handcrafted items may have natural variations as described in Section 4.
17) Limitation of Liability
To the maximum extent permitted by law:
GS Handcrafts will not be liable for indirect, incidental, special, or consequential damages (including loss of profits, data, or goodwill).
Our total liability for any claim relating to the Site, products, rentals, or services will not exceed the amount you paid for the specific order or rental giving rise to the claim.
18) Indemnity
You agree to indemnify and hold GS Handcrafts harmless from claims, losses, liabilities, and expenses (including legal fees) arising out of your misuse of the Site, violation of these Terms, or infringement of any rights of a third party.
19) Privacy
Your use of the Site is also governed by our Privacy Policy on the Site.
20) Governing Law and Disputes
These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law rules, and disputes will be handled in the courts located in Ontario, unless your local consumer laws require otherwise.

21) Severability
If any section of these Terms is found unenforceable, the remaining sections remain in effect.
22) Entire Agreement
These Terms, together with any policies posted on the Site (including the Refunds & Returns Policy and Privacy Policy), form the entire agreement between you and GS Handcrafts regarding the Site and purchases/rentals.
